Mr. Victor Diaz, a Dominican national and Captain of the Dominican Fishing Vessel Sheila which allegedly rammed the HMBS MADEIRA whilst in Bahamian territorial seas on Wednesday November 2, 2016 appeared before Magistrate Andrew Forbes at Court number 8 on Friday January 20, 2017. He was charged with two (2) offences.

On the first offences Mr Diaz was charged with eight (8) counts of causing the safety of the HMBS Madeira to be endangered with intent to cause danger of harm.

The specification of the charge read that Victor Diaz on Wednesday November 2, 2016, whilst in the territorial sea of The Bahamas, caused the safety of the HMBS Madeira to be endangered with intent to cause danger of harm to eight (8) Crew Members of the HMBS MADEIRA.

Mr. Victor Diaz was also charged with one (1) count of Damage in that on Wednesday November 2, 2016. The specification of the charge read that whilst in the territorial sea of The Bahamas, he Mr. Victor Diaz did intentionally and unlawfully caused material damage exceeding $25 in value to the HMBS Madeira.

Mr. Diaz who was unrepresented pled not guilty to the offences and the Prosecution led by Director of Public Prosecutions Mr. Gavin Gaskin and
Senior Counsel Mr. Ambrose Armbrister were called to present their case.

The case was adjourned to Monday February 27, 2017.
